Former West Virginia cornerback Jordan Scruggs and defensive lineman Eddie Kelly Jr. are seeking an additional season of NCAA eligibility, with a court hearing scheduled for next week on their request for a temporary restraining order and preliminary injunction.

The hearing is set for the first week of August in Monongalia County. While there is not an official date set yet, it will determine whether the two former Mountaineers can receive immediate relief while their legal challenge moves forward.
If granted, the injunction could allow Scruggs and Kelly to compete during the 2026 season as the case proceeds through the courts.
The details
The lawsuit centers on the NCAA’s eligibility rules, with the former West Virginia players arguing they should be permitted to play during the 2026 season. Scruggs is being represented by Blake Sercye of Sperling Kenny Nachwalter.
The addition of both players would provide West Virginia with experienced depth and talent at their respective positions.
The players
Scruggs started 20 of the 35 games he played in throughout his collegiate career. Of note, the Kansas City native racked up 135 total tackles and 12 PBU, while adding two interceptions. Before joining WVU for his final year, Scruggs spent time at South Alabama, Hutchinson CC, and Central Missouri.
As for Kelly, the defensive lineman made nine starts in 49 career games. He tallied 103 tackles, three sacks, 13.5 TFL, eight PBU, and a fumble recovery. As another journeyman, Kelly also played at Missouri, Georgia Tech, and USF.
